By accessing or using this website (the "Site"), you agree to these Terms of Service. If you do not agree, do not use the Site.

The Site is an informational portfolio for the audiovisual project "Auscultate", including biographical content, press materials and links to third-party music platforms. The Site does not sell goods or services and does not collect payment information.

All text, design, code, logos, photography, audio and other materials on the Site are owned by Auscultate or its licensors and are protected by copyright, trademark and other laws. The name "Auscultate" and associated branding are claimed as trademarks of the project owner.

Press images on the /press page may be used by journalists, promoters and venues solely to promote Auscultate, with credit. No other use, modification, resale or AI-training use is permitted without prior written consent.

You may not scrape, mirror, frame, or systematically reproduce the Site.

You agree not to: (a) violate any law; (b) interfere with or attempt to compromise the Site's security or availability; (c) attempt to gain unauthorized access to any system; (d) use automated means to overload the Site; or (e) use the Site to harass, defame or harm others.

The Site links to and embeds content from third-party platforms (e.g. SoundCloud, Spotify, Apple Music, Beatport, Instagram, TikTok, YouTube). We are not responsible for the content, policies or practices of those third parties. Use of those platforms is governed by their own terms.

Inquiries sent to auscultateofficial@gmail.com do not create a binding agreement. A booking is only confirmed by a separate written agreement signed by Auscultate (or its authorized representative).

The Site is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure.

To the maximum extent permitted by law, Auscultate and its agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or goodwill, arising from your use of the Site. Total aggregate liability for any direct claim is limited to USD 100.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold Auscultate harmless from any claim arising from your misuse of the Site or breach of these Terms.

We may modify the Site or these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms. We may suspend or terminate access at any time, without notice, for any reason.

These Terms are governed by the laws applicable at the place of residence of the project owner, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection law provides otherwise.
